Ketan Tipnis has 25 years of construction industry and consulting experience in project management, claims and dispute resolution. He has represented owners and contractors on domestic and international capital projects and disputes involving schedule delay, loss of productivity and damages quantification. He has worked on several mega projects globally in the US, UK, UAE, Brazil, Hong Kong and India.

Ketan has provided commercial risk and contract management services on a wide range of projects; ranging from oil and gas, petrochemical, steel plants, building and civil engineering infrastructure projects. He is also a certified Project Management Professional.

Project Highlights

Steelmaking Plant – Team Leader for an engagement involving a dispute between the owner of the steel plant and the project manager on a $250 million GMP contract. The project included an evaluation of various contractors’ claims totaling $60 million which included variance analysis to allocate and justify the costs overrun for each GMP contractor. The project evaluation also included disruption analysis for lost productivity using a measured mile approach. Assisted in drafting the expert report and preparation for deposition.

Metro Rail – Team member for the quantification of financial damages for the Dubai Metro Rail (Red Line) for a $2.5 billion project on behalf of a joint venture of international contractors. The dispute was approximately $1 billion. Main tasks involved a review of the contractor’s budget estimates and cost forecast report, as well as performing transaction testing of labor, materials, equipment, MEP and subcontractor works. The project also included performing a valuation of the disputed variations and advise on the fair value of the changes.

International Airport – Performed a schedule delay analysis on behalf of the Airport Authority. Evaluated the contractor’s change orders and other issues. Analyzed the contractor schedules using Primavera and provided delay analysis support to the overall window analysis. Assisted in drafting findings for mediation.

Steelmaking Plant – Team member on-site for a $7 billion steel making process plant construction providing risk and claims management services. Led coordination and client management in a multinational cultural environment as an owner’s representative. Managed various areas of the plant such as the coker plant, blast furnace and the steel plant. The project included coordination with the client executive management and legal advisors on critical claims issues. Performed independent analysis of the plant master schedule to project the realistic completion date. The project resulted in providing expert witness testimony in arbitration for production delays and quantum for piling/civil works dispute of $50 million in the Brazil-Canada Chamber of Commerce in Rio.
