Patrick Spare has more than 20 years of experience in project management, construction claims analysis and CPM scheduling. His responsibilities include forensic CPM scheduling analysis, project cost and efficiency evaluation, project event and issue analysis, and development of fully exhibited reports as part of analyses for construction management disputes, delay/inefficiency claims, and litigation. His project experience includes government facility, commercial development, hotel and condominium, hospital, civic venue (museum & stadium), power, heavy civil and industrial projects – both within and outside of the United States. His previous experience includes value engineering, budgeting and cost estimating, lump sum and GMP contract development, scheduling, project management, and contract administration for commercial development projects in the general contractor’s role.

Project Highlights

CityStars Development — Provided claims analysis on behalf of developer to evaluate a $140 million delay and disruption claim on a mixed-use development project in Egypt. The project was comprised of 29 building blocks, 800,000 square meters, and included a commercial podium structure, hotels, office buildings and high-rise apartments. Evaluated the plaintiff’s system dynamics simulation model and identified deficiencies in model architecture, objective and subjective data inputs, lack of supporting project data, bias/imbalance in the analysis of alleged impacts, lack of transparency in the analysis methodology, and legal hurdles for the use of system dynamics in litigation as opposed to negotiation/mediation. Assisted in the development of the expert report of findings submitted in international arbitration and with a presentation for testimony. Assisted attorneys in the development of post-trial brief and rebuttal documents.

Cardiovascular Center — Represented design team, owner, and general contractor for analysis of Mechanical and Insulating contractors’ delay and disruption claim totaling $19 million on the construction of a new, six-story Cardiovascular Hospital in Ann Arbor.  Evaluated the contractor’s earned value measured mile analysis, including detailed review of project bid documents, budgeting documents, and contemporaneous cost records. Developed alternative earned value productivity analysis to contrast with contractor’s analysis. Performed detailed review of project plans and bid takeoff verification. Presented findings via expert report for arbitration.

U.S. Courthouse in Texas — Retained by GSA for the evaluation of delay and disruption claims presented by the general contractor and subcontractors related to the construction of a new $74 million, eight-story, 239,000 square foot Federal Courthouse building complex. Critiqued the total cost and measured mile methodologies implemented in each claim related to alleged delay and disruption damages. Analyzed contemporaneous project records and performed a detailed schedule analysis in response to contractor’s delay analysis to identify and apportion delays and responsibility for project impacts. Developed an exhibited expert report of findings for submission to the court in preparation for trial proceedings.

Airport Baggage Handling System — Represented the City of Philadelphia for evaluation of general contractor’s schedule delay claims involving the installation of a new baggage handling system at Philadelphia International Airport. The project included design, fabrication, and installation of the baggage handling conveyors, scanning, sorting, and explosive detection equipment, development of the system monitoring and operation software package, as well as startup and system testing/commissioning by TSA. Provided analysis of project technical issues and performed a detailed time impact schedule analysis to quantify and determine the causes of critical project delays. Collaborated in preparation of an expert report to present findings, reviewed contractor’s delay analysis, and substantiate withholding of liquidated damages.
